As required by our state constitution, The Florida Supreme Court is required to undertake an annual rigorous analysis and certification process to determine whether new judge positions are required based on caseloads and various other factors. For the last 12 years, The Florida Supreme Court has certified new judge positions, but the Florida Legislature has not funded any new judge positions. Last year, the Ninth Judicial Circuit was certified for two new circuit court judge positions. None were funded by the Florida Legislature. This is the case even though our constitution provides that Florida?s Judicial Branch is an equal and independent branch of our state government. With that said, it receives less than 1.0% of the state?s annual budget.
In light of the Legislature?s failure to fully fund the Judicial Branch, and in particular, the Ninth Judicial Circuit, Judge Lauten was forced to close our complex business court and move those two judges to the family law division. This closure affects all businesses having legal disputes in Central Florida and has further impacted other divisions of the court.
